In consideration of being allowed to participate in the activities and programs offered by Heavy Metal Barbell Club ("HMBC"), and to use its programs and training, in addition to the payment of any fee or charge, I do hereby waive, release and forever discharge and hold harmless HMBC and its trainers, officers, agents, and employees from any and all responsibility, liability, cost, and expenses, including injuries or damages, resulting from my participation in any activities, or my use of any programs designed by HMBC. I do also hereby release HMBC its trainers, officers, agents and employees from any responsibility or liability for any injury or damage to myself, or in any way arising out of or connected with my participation in any activities with HMBC or the use of any equipment of HMBC.

I understand and am aware that strength, flexibility, and aerobic exercise, including the use of equipment, are a potentially hazardous activity. I also understand that fitness activities involve a risk of injury and even death and that I am voluntarily participating in these activities and using equipment and machinery with knowledge of the dangers involved. I hereby agree to expressly assume and accept any and all risks of injury or death related to said fitness activities.

I do hereby further declare myself to be physically sound and suffering from no condition, impairment, disease, infirmity or other illness that would prevent my participation or use of equipment or machinery except as hereinafter stated. I do hereby acknowledge that HMBC has recommended to me that I obtain a physician’s approval for my participation in an exercise/fitness activity or in the use of exercise equipment and machinery.

I also acknowledge that HMBC has recommended that I have a yearly or more frequent physical examination and consultation with my physician as to physical activity, exercise and use of exercise and training equipment so that I might have his/her recommendations concerning these fitness activities and equipment use. I acknowledge that I have either had a physical examination and been given my physician’s permission to participate, or that I have decided to participate in activity and use of equipment, machinery, and programs designed by HMBC without the approval of my physician and do hereby assume all responsibility for my participation and activities, and utilization of equipment and machinery in my activities. In addition, I hereby represent and warrant that I am currently covered by an accident and health insurance policy.

Equipment Policy

I agree to respect all HMBC equipment. This includes not dropping empty barbells, barbells with 10kg or less loaded, dropping kettlebells/dumbbells from above knee height, etc. I understand that I will be issued a verbal warning on my first offense. Any subsequent offense will result in a charge to replace or repair the equipment in question.

Membership Policies

All HMBC memberships are set up for a required three-month contract before reverting to a month-to-month subscription. All HMBC Memberships are set up to auto-renew on the members' designated billing date. The billing date is determined by the date the member signs up for his/her membership. If the member wishes to cancel their membership, he/she must notify HMBC via email 15 days prior to the members' billing date. If the member fails to notify HMBC of the wish to cancel with 15 days' notice, the membership will be processed as normal or can be bought out for 50% of the contract cost. Failure to attend class does not relieve you of the obligation to pay for your membership. If a payment fails to process, the member will be charged a $20 failed payment fee in addition to their membership rate.

An HMBC membership may be suspended for a total of 2 months in a calendar year. Written notice of suspension must be submitted 15 days prior to the members' billing date. Holds are unable to be placed retroactively. Upon expiration of the hold, the member’s account will automatically become active, and payments will resume as described above.

Each member is required to provide ACH information when signing up for any membership level, class, or service. This information will be used to process membership payments each month.

Personal Training Cancellation Policy

If a member needs to cancel a personal training session, the member must submit a cancellation request via email at least 12 hours before the session is to begin. If less than 12 hours notice is given, the member will be charged 50% of the personal training session rate. If the cancellation is submitted less than three hours before the session is to being, the member will be charged 100% of the personal training session rate.

HMB HQ Rules

All HQ Members agree in good faith to adhere to the HQ House Rules, which exist to set the standards of expected behavior and regulate the intended culture of HMB. Blatant violation of the rules will lead to reminders and discussion. Repeated violations will lead to dismissal from the program.

  • Be A Teammate—respect all athletes and coaches.

  • No Phone Usage unrelated to training (Accepted Usage: True Coach, Video Analysis, Music, Calculator.)

  • Return Equipment to its proper home.

  • Pay Attention—demonstrate awareness of your surrounds, teammates, and self.
